Please read these Terms of Service carefully before using the Artie AI platform. These Terms constitute a binding legal agreement between you and Artie AI.
1. Acceptance of Terms
By accessing or using Artie AI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.
If you are accessing the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of Service
Artie AI provides a cloud-based salon management platform including appointment scheduling, client relationship management, employee management, payment processing, analytics, and AI-powered business intelligence features (collectively, the "Service").
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes. Your continued use of the Service after such notice constitutes your acceptance of the modified Service.
3. User Accounts
To access most features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Keep your password confidential and not share it with any third party.
- Notify us immediately of any unauthorised use of your account.
- Accept responsibility for all activities that occur under your account.
We reserve the right to disable any account, at any time and without prior notice, if we reasonably believe it has been used in violation of these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Upload, transmit, or distribute any content that is unlawful, harmful, defamatory, or obscene.
- Attempt to gain unauthorised access to any portion of the Service or related systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Scrape, data-mine, or extract data from the Service using automated means without our prior written consent.
- Reproduce, duplicate, copy, sell, or resell any portion of the Service without express written permission.
- Introduce any malware, viruses, or other harmful code into the Service.
5. Payment Terms
Certain features of the Service require payment of fees. By selecting a paid subscription plan, you agree to pay the applicable fees.
- Fees are billed in advance on a monthly or annual basis, depending on the plan you select.
- All payments are processed securely through Stripe. By providing payment information, you authorise us to charge your payment method for fees incurred.
- Fees are non-refundable except where required by law or as explicitly stated in our refund policy.
- We reserve the right to change our pricing with 30 days' written notice. Continued use after a price change constitutes acceptance of the new pricing.
- Failure to pay fees may result in suspension or termination of your access to the Service.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Artie AI and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You retain ownership of all data you input into the Service ("Customer Data"). You grant us a limited, non-exclusive, royalty-free licence to use Customer Data solely to provide and improve the Service. We will not use Customer Data for any other purpose.
We may use anonymised, aggregated data derived from Customer Data to improve our analytics models and platform features.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Artie AI and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of your use of (or inability to use) the Service.
Our total aggregate liability to you for any claims arising under or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred United States dollars (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
8. Termination
You may terminate your account at any time by contacting us at hello@artie-ai.com or through the account settings within the platform.
We may suspend or terminate your access to the Service at any time with or without cause and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, non-payment of fees, or conduct that we determine may harm Artie AI or other users.
Upon termination, your right to access and use the Service immediately ceases. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Artie AI operates, without regard to conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall first be subject to good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitral body.
